Massachusetts Age Discrimination

It is illegal to discriminate against applicants and employees who are more than 40 years old.  Workers under the age of 40 are not protected from age discrimination in Massachusetts.  Furthermore, employers with more than six employees are covered by the age discrimination statutes. 

Exceptions:

You may discriminate against younger employees over the age of forty in favor of older employees.  For instance, the Supreme Court has found that an employer could favor employees in their 50s at the expense of employees in their 40s.
